1. GENERAL INFORMATION

1.1 This document ("Privacy Policy") relates to Sol og Strand Feriehusudlejning A/S’s ("Sol og Strand", "us", "our", "we") collection and processing of personal data about our website visitors, homeowners and tenants via Sol og Strand.

1.2 Sol og Strand is the data controller for your personal data. Any enquiries regarding the processing of personal data should therefore be communicated to us via the contact details:

2.1 We process the following personal data of website visitors:

3. PURPOSE OF THE PROCESSING

3.1 We process the above personal data for the following purposes:

(a) Providing holiday home rentals and required administration in relation thereto
(b) Fulfilling the agreement with you and safeguarding your rights in relation thereto
(c) Understanding and improving homeowner and tenant relationships in relation to the rental experience
(d) Targeted marketing, including retargeting, profiling and sending newsletters
(e) Optimising the user experience and features for visitors to our website

4. LEGAL BASIS FOR PROCESSING

4.1 We process your personal data for the above purposes based on different legal bases.

(a) Consent: Sol og Strand obtains your consent to the processing of personal data when you sign up for our newsletter.
(b) Necessary for the performance of a contract to which you are a party: Sol og Strand processes your personal data in order to comply with the holiday home rental agreement with you as the tenant and the rental listing agreement with you as the homeowner.
(c) Necessary for the performance of a legal obligation: Sol og Strand processes your personal data related to payment in connection with the holiday home rental agreement with you as tenant and the rental listing agreement with you as the homeowner in order to comply with legal requirements on bookkeeping and accounting.
(d) Legitimate interest: Sol og Strand processes your personal data to optimise the user experience and functions of our website, to carry out targeted marketing, to conduct satisfaction surveys, to enter into and administer the contractual relationship and to safeguard your rights, as well as for our own security, including preventing the occurrence of fraud, based on our legitimate business interests.

4.2 You have the unconditional right to object to the processing of your personal data for direct marketing purposes. You also have the right to withdraw your prior consent. The withdrawal of your consent has no consequences for the lawful processing of the personal data prior to your withdrawal, just as we may continue to process your personal data on other lawful grounds, except for direct marketing.

4.3 If you object to the processing of your personal data which is processed on the basis of our legitimate interests, we will immediately stop processing your data for those purposes.

5. USE OF THIRD PARTIES

5.1 Data may be transferred to external partners who process data on our behalf. We use external partners for, among other things, technical operation and improvement of the website, sending newsletters and targeted marketing, including retargeting, and for your rating of our company and services. For example, when you rate us and our services on TrustPilot via a link from us, information about your name and customer number is passed on to TrustPilot in order to verify your customer relationship with us. When you write in our guestbook, you can actively choose to have your name published on the Website. These companies are data processors under our instruction and process data for which we are the data controller. The data processors may not use the data for any other purpose than the performance of the agreement with us, and are subject to a duty of confidentiality. We have entered into written data processing agreements with all data processors who process personal data on our behalf.

5.2 Sol og Strand uses two data processors located outside the EU (Google and Facebook). We have entered into data processing agreements with them based on the most recently approved standard contractual clauses (SCCs).

5.3 Sol og Strand passes on your personal data (name, address, email, phone number, order number) to Tryg Forsikring. Tryg Forsikring provides insurance to our tenants for cancellation, interruption, contents liability and medical assistance. Tryg Forsikring is an independent data controller for the processing of your personal data. We therefore recommend you to read their privacy policy.

5.4 As a tenant, your name and nationality will be displayed on the holiday homeowner's login.

6. STORAGE OF PERSONAL DATA

6.1 Personal data collected about your use of the website will be deleted/anonymised at the latest when you have not used the website for one year.

6.2 Personal data collected in connection with your subscription to our newsletter will be deleted/anonymised when your consent to the newsletter is withdrawn, unless we have another basis for processing the data.

6.3 Personal data collected in connection with the rental agreement will generally be deleted/anonymised five years after the end of the calendar year in which you made your purchase. However, personal data may be stored for a longer period if we have a legitimate need for longer storage, for example if required for the establishment, exercise or defence of legal claims or if storage is required for us to comply with legal requirements. Accounting records are stored for five years until the end of a financial year in order to comply with the requirements of the Danish Bookkeeping Act.

6.4 Personal data collected in connection with the rental listing agreement will generally be deleted/anonymised three years after the end of the calendar year in which the rental listing agreement expired. However, personal data may be stored for a longer period if we have a legitimate need for longer storage, for example if required for the establishment, exercise or defence of legal claims or if storage is required for us to comply with legal requirements. Accounting records are stored for five years until the end of a financial year in order to comply with the requirements of the Danish Bookkeeping Act.

7. YOUR RIGHTS

7.1 You have the following rights in relation to our processing of personal data about you.

(a) You have the right to access the personal data we process about you and a range of additional data.
(b) You have the right to have incorrect data about yourself corrected.
(c) In exceptional cases, you have the right to have personal data about you deleted before the time of our general deletion.
(d) In certain situations, you have the right to restrict the processing of your personal data. If you have the right to restrict the processing, we may only process personal data in the future – apart from storage – with your consent, or for the establishment, exercise or defence of legal claims, or to protect an individual or important public interests.
(e) In certain situations, you have the right to object to our otherwise legal processing of your personal data. You can also object to the processing of your personal data for direct marketing purposes.
(f) In certain situations, you have the right to receive your personal data in a structured, commonly used and machine-readable format and to have such personal data transferred to another controller.

9. NOTICE OF CHANGES TO THIS PRIVACY POLICY

9.1 If we make any changes to this Privacy Policy, we will publish such changes on the website where this Privacy Policy is posted. It is your responsibility to keep yourself updated about changes to the Privacy Policy. Where such changes require your consent or are based on a change in the processing of your personal data, we will provide you with further, separate notice of the circumstances and request your consent in accordance with Applicable Data Protection Legislation.
